VINYL WINDOW AND PATIO DOOR LIMITED WARRANTY
Our Warranty Guarantee to You
We warrant that our manufactured vinyl windows and patio doors are free from defects that would cause obstruction of view due to dust or moisture subject to the exclusions, disclaimers, and limitations below. Should our product fail due to defects in the material and workmanship, Empire Pacific Windows® will repair or replace that product free of charge.
Owner Occupied Single Family Residence Lifetime Limited Warranty
Empire Pacific Windows® warrants it will repair or replace, at its option, any product it manufactures that is defective in materials or workmanship for the life of the home. This limited lifetime warranty is extended solely and exclusively to the original purchaser of our manufactured vinyl windows and patio doors. In the event you sell your single family residence, or it becomes occupied by someone other than the original purchaser of our product, the warranty is then reduced to a period of ten (10) years from the original purchase dater..
Proof of original ownership or purchase may be required.
Commercial Ten Year Limited Warranty
For all other structures that are not owner occupied single family residences; Empire Pacific Windows® warrants it will repair or replace, at its option, any product we manufacture that is defective in materials and/or workmanship. The warranty is for ten (10) years on glass and material, and for a period of
five (5) years on labor from the original date of purchase. Warranty Exclusions
OUR WARRANTY DOES NOT APPLY TO THE FOLLOWING:
- PRODUCTS AND APPLICATIONS SOLD BY Empire Pacific Windows® COVERED BY OTHER MANUFACTURES WARRANTIES.
- GLASS BREAKAGE, STRESS CRACKS AND SEAL FAILURES, WHERE SEAL FAILURES ARE INCIDENTAL TO GLASS BREAKAGE.
- PRODUCTS NOT PROPERLY STORED, HANDLED OR INSTALLED OR NOT INSTALLED IN COMPLIANCE WITH BUILDING CODES.
- DAMAGE OR DEFECTS CAUSED BY MISUSE, IMPROPER CARE OR IMPROPER MAINTENANCE, OR ACTS OF NATURE SUCH AS FIRE, FLOOD
AND EARTHQUAKE.
- PRODUCTS THAT ARE ALTERED AFTER THE SALE INCLUDING, BUT NOT LIMITED TO, THE USE OF TINTS, FILMS AND APPLIED FINISHES.
- PRODUCTS INSTALLED IN CORROSIVE, HIGH MOISTURE OR OTHER HARSH ENVIRONMENTS OR OUTSIDE THE ACTIVE TRADE AREA OF EPW.
- DAMAGE CAUSED BY NORMAL WEAR AND TEAR, INCLUDING BUT NOT LIMITED TO, DISCOLORATION OR NATURAL FADING.
- PRODUCTS INSTALLED IN STRUCTURES NOT IN COMPLIANCE WITH BUILDING CODES.
- CLEARANCE SALE PRODUCTS OR ANY PRODUCTS NOT PAID FOR IN FULL.
- DEFECTS TO SCREENS THAT OCCUR MORE THAN ONE (1) YEAR FROM THE ORIGINAL DATE OF PURCHASE.
Disclaimer of Liability
Except for the express warranty stated above, EPW makes no other warranties, either express or implied, including any implied warranties of merchantability and/or fitness for a particular purpose.
Limitation of Remedies
In no event shall EPW be liable for direct, indirect, incidental, consequential or special damages. No distributor, dealer or representative of EPW has the authority to change, modify, or expand this warranty. You may also have other rights which vary from state to state.
